In general terms, the law of Conveyancing involves the transfer of legal title of a property from one person to another, or otherwise the granting of an encumbrance over a property in favour of another.

The Conveyancing process can either involve the buying and selling of property and the process includes;

  • If purchasing a property, reviewing and providing you with written or verbal advice on a Contract for sale and the effect that it will have on you.
  • Negotiating directly with the vendor solicitor on your behalf in relation to amendments to the Contract for sale.
  • Attending to exchange of contracts.
  • Advise you on the payment of stamp duty and the methods of paying such duty including and assisting with any exemptions or concession applications
  • Preparing settlement adjustment figures and ensuring proper adjustments of council and water rates and if relevant strata levies.
  • If you are buying a property and you have a financier providing you with a loan, loan documents are required to be signed and returned to the Lender together with their requirements.
  • Liaising with your Lender to provide any requirements and liaise with them to arrange settlement time and place and provide them with cheque direction.
  • If you are selling your property a contract for sale is required to be prepared on your behalf before you will be able to market the sale of your property.
  • Also if you are selling your property, we would write to your discharging mortgagee after exchange to ensure that they will be in a position to settle the matter, and provide a payout figure and have the Certificate of Title available for settlement.
